Agreement: I agree that notwithstanding what is written in my membership agreement, EOS may operate its facilities in whatever manner it chooses and in its sole discretion in order to address the current pandemic, including but not limited to: limiting the number of members present in a club or in an area of a club at any given time; refusing access to member exhibiting symptoms of illness; keeping certain amenities such as saunas and steam rooms closed or limiting access to same; requiring that staff and members maintain social distancing; taking any other action EOS deems to be in the best interests of the safety of its team and its members. I agree that in addition to the release contained in my membership agreement, by using an EOS facility I assume all risk of contracting a virus or disease and release EOS from any liability therefor, even if the result of EOS’s negligence.
